These Terms of Service ("Terms") are an agreement between you, the driving school using the platform, and Driving Sathi, the company that operates the Driving Sathi software ("we", "us"). By creating an account or using the platform, you accept these Terms.
1. Accepting these terms
You confirm that you are at least 18 years old and authorised to enter into this agreement on behalf of your driving school. If you are using Driving Sathi on behalf of a registered business, you confirm that you have the authority to bind that business to these Terms.
2. Your account
- You are responsible for everything that happens under your account — including the actions of staff you add.
- Keep your password secure. Share it with nobody.
- Notify us immediately if you suspect unauthorised access — email security@drivingsathi.com.
- Owners may invite additional users. Each user must use their own credentials — no account sharing.
3. Free trial
New driving schools may start a 30-day free trial with full access to the platform — no payment details required.
- The trial ends automatically after 30 days unless you choose a paid plan.
- If you don't choose a paid plan, your account moves to a read-only state for 14 days and is then archived. Your data is preserved during this period and can be reactivated.
- We reserve the right to limit, change or end the trial offer for new accounts at any time.
4. Subscriptions & billing
- Subscription fees are billed monthly or yearly in advance, in Nepalese Rupees (NPR).
- The exact fee is shown on the pricing page and confirmed when you sign up.
- Subscriptions renew automatically at the end of each billing period unless cancelled in advance.
- We may change subscription prices — for existing customers, any price increase will be communicated at least 30 days before the renewal date.
- If a payment fails, we'll retry up to three times over 14 days. After that, your account moves to a read-only state.
- You're responsible for any taxes that apply under Nepali law.
5. Refunds & cancellations
You can cancel your subscription at any time from your account settings or by emailing billing@drivingsathi.com. Cancellation takes effect at the end of your current billing period.
- Monthly plans — no refund is issued for the current month. You continue to have access until the end of the period.
- Yearly plans — if you cancel within the first 14 days, we'll refund the full amount. After 14 days, no refund is given.
- Refunds, when due, are processed back to the original payment method within 10 business days.
6. Acceptable use
When using Driving Sathi, you agree not to:
- Use the platform for any unlawful, fraudulent or harmful purpose
- Impersonate another person or school
- Upload viruses, malware or attempt to break the platform's security
- Scrape, copy or resell the platform or its data to third parties
- Use the platform in a way that overwhelms the infrastructure (rate-abusive API use, etc.)
- Send spam, illegal content or harassing messages through our reminder/SMS channels
Violations may result in immediate suspension. We reserve the right to determine, in our reasonable judgment, what counts as a violation.
7. Your data & ownership
You own your data. All student records, attendance logs, invoices, receipts and other operational data your school enters into Driving Sathi belong to your school. We are the custodian, not the owner.
- You can export your data at any time in standard formats (Excel/CSV/PDF).
- We may aggregate & anonymise data across the platform to improve features & produce industry insights — this anonymised data does not identify your school or your students.
- For everything else, see our Privacy Policy.
8. Uptime & support
- We target 99.5% monthly uptime, measured outside planned maintenance windows.
- Planned maintenance is communicated in advance via in-dashboard banners and email.
- Support is provided in Nepali & English, Monday to Friday, 10 AM to 7 PM Nepal time. Yearly customers get priority support and a dedicated account manager.
- We aim to respond to support requests within 4 business hours and resolve urgent issues within 1 business day.
9. Suspension & termination
We may suspend or terminate your account if:
- You fail to pay your subscription after the grace period
- You materially violate these Terms (especially the Acceptable Use section)
- We are required to do so by Nepali law
Whenever possible, we will notify you in advance and give you a chance to fix the problem. In the event of termination, you have 60 days to export your data before it is permanently deleted from our active systems.
10. Liability
Driving Sathi is provided on an "as is" basis. We work hard to keep the platform secure, accurate and reliable, but we cannot guarantee that it will be free of bugs or interruptions.
- To the maximum extent permitted by Nepali law, our total liability to you under these Terms is limited to the subscription fees you have paid us during the 12 months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, consequential or punitive damages — including loss of revenue, loss of data, or business interruption.
- You are responsible for verifying that the records produced by Driving Sathi comply with any audit, tax or government requirements applicable to your school.
11. Governing law
These Terms are governed by the laws of Nepal. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
